The California Supreme Court decided Wednesday to hear UC Berkeley’s appeal regarding the planned construction on People’s Park. This is the latest development of the case Make UC a Good Neighbor v. UC Board of Regents. If the court rules in favor of campus, current plans for development on People’s Park will be allowed to continue.
This appeal comes after California’s First District Court of Appeals ruled 3-0 that UC Berkeley failed to consider alternative options for development.
The state Supreme Court voted unanimously to hear campus’s appeal. The city of Berkeley and Governor Gavin Newsom both urged the state Supreme Court to hear campus’s case and to overrule the appeals court’s decision which forces the university to consider alternative development plans. According to the ruling, campus did not adequately provide explanations or reasonings as to why alternative sites listed in their development plan were not satisfactory or worthy of consideration.
The decision to hear campus’s appeal comes with support by both Berkeley Mayor Jesse Arreguín and campus.
